I understand that all lead purchases are final and that Webwerxx, Inc. does not offer refunds for lead purchases. I also agree and understand that Webwerxx, Inc. cannot guarantee the number of leads delivered per day. I also understand and agree that if any dispute arises regarding this purchase of leads, any and all legal actions and or proceedings will occur in the State of Colorado. Terms and Conditions 1. General. (a) This Agreement sets forth the terms and conditions which apply to the use of the Webwerxx, Inc. service by Subscriber (also known as Customer/Client). No representation, warranty, term or condition, other than as specifically set forth in this Agreement, shall be binding on Webwerxx, Inc.   (b) Webwerxx, Inc. shall have the right at any time to change or discontinue any aspect or feature. Either Webwerxx, Inc. or Subscriber may terminate the service to Subscriber at any time. Webwerxx, Inc. shall have the right to add to, modify or delete any provision of this Agreement, and Webwerxx, Inc. has the right to add to, modify or delete any other terms of use at any time. (c) Subscriber represents and warrants that he/she is at least 18 years of age. (d) Subscriber is responsible in all respects (including payment obligations) for all use of Subscriber's Account and all use by others of Subscriber's Account. Subscriber will ensure that all use of Subscriber's Account complies fully with the provisions of this Agreement and all terms of use. (e) Transfer of the Account by Subscriber to any other person or entity is prohibited. 2. Charges. (a) Subscriber agrees to pay for his/her subscription at the point of purchase by using an acceptable and valid credit card or checking account at point of purchase through Paypal.com or directly to Webwerxx, Inc. 3. Subscriber Conduct. (a) Subscriber shall not post or transmit through Webwerxx, Inc. any material that constitutes unsolicited email or as otherwise referred to as "spam." (b) Subscriber shall use the Webwerxx, Inc. system for lawful purposes only and in accordance with this Agreement. Subscriber shall not upload, post, transmit or otherwise make available on or via the Webwerxx, Inc. system any material (including any message or series of messages) that violates or infringes in any way upon the rights of others, that is unlawful, threatening, abusive, obstructive, harassing, libelous, invasive of privacy or publicity rights, that in the circumstances would be obscene or indecent, that constitutes hate speech, that is otherwise offensive or objectionable, or that encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law. (c) Subscriber shall not upload, post, transmit or otherwise make available on or via the Webwerxx, Inc. system any material protected by copyright, trademark, patent, trade secret or other proprietary right in a manner that infringes or violates any such right. (d) The Webwerxx, Inc. system contains copyrighted material, trademarks and other proprietary information, and the entire content of the Contact Manager system is copyrighted as a collective work under the United States copyright laws. Except as granted herein or as otherwise expressly permitted under copyright law, no copying, redistribution, publication or commercial exploitation of downloaded material will be permitted without the express prior written consent of Webwerxx, Inc. and, where applicable, the third party copyright owner. In the event of any permitted copying, redistribution or publication of copyrighted material, no changes in or deletion of author attribution or copyright notice shall be made. (e) Subscriber will not resell the Webwerxx, Inc. service, or any portion thereof, or otherwise charge others to use Webwerxx, Inc., or any portion thereof. Further, Subscriber will not redistribute Webwerxx, Inc., or any portion thereof, whether or not Subscriber receives compensation for such redistribution. (f) Subscriber acknowledges that Subscriber is responsible for and assumes all risks with respect to whether materials uploaded, posted or otherwise made available on or via Webwerxx, Inc. through Subscriber's Account may violate any laws or rights. 4. Disclaimer of Warranty; Limitation of Liability. (a) Subscriber agrees that the Webwerxx, Inc. system is provided on an "as is" basis without warranties of any kind, either express or implied, including but not limited to warranties of title or non-infringement or implied warranties of merchantability or fitness for a particular purpose, other than those warranties that are implied by and incapable of exclusion, restriction or modification under the laws applicable to this agreement. Subscriber further agrees that all use of the Webwerxx, Inc. system (including but not limited to the accessing and use of content, information and services the purchase of merchandise and services and the transmission of information and other communications by and to subscriber) is at Subscriber's sole risk. (b) Webwerxx, Inc. makes no representations, claims or warranties, other than what is published on this website. Representations, claims or warranties received via any media, conference, conference calls, seminars may or may not be outside of those approved by Webwerxx, Inc. and Members should rely solely on the information published at the website. (c) Webwerxx, Inc. is an internet based service and as such is subject to all of the uncertainties caused by computer malfunctions, server viruses, electrical failures, vandalism, corrupted software, corrupted data and a multitude of other technical difficulties that are peculiar and unique to the internet. Even though Webwerxx, Inc. takes reasonable precautions to prevent such technical difficulties it makes no warranties or guarantees of operations free of such unknowns. Such technical difficulties could affect lead delivery, accounting reports and data preservation. Each customer is advised to maintain their own records of leads purchased, order dates and training information off site to assure safety and security of their information. (d) Subscriber agrees that any and all legal disputes, including attorney meetings and court proceedings, regarding lead purchases will take place in the State of Colorado. 5. Indemnification. Subscriber agrees to defend, indemnify and hold harmless Webwerxx, Inc. from and against any and all claims and expenses, including reasonable attorneys' fees, arising out of or related in any way to the use of the Webwerxx, Inc. system by Subscriber or otherwise arising out of the use of Subscriber's account. 6. Update of Information Each subscriber accepts full responsibility for modification of member information. Members agree to not hold Webwerxx, Inc. liable for changes in their information which is under the full and entire control of the Member. 7. Refund of Leads There is no refund for leads already delivered. 8. Lead Delivery Timetable Leads usually begin delivery within 1-3 days of the day you order. If Subscriber does not receive leads within 3 days of payment, it is the responsibility of the Subscriber to contact Webwerxx, Inc. to inquire about delivery times and dates. 9. Bad Lead Policy Please forward a copy of your bad lead to webwerxx@aol.com within 2 days of receipt of the lead. After we verify that your lead is in fact bad (a bad lead is a lead which has both a bad phone number and non-deliverable email address), we will replace the lead. Leads from minors, duplicate leads and leads with incomplete phone numbers are also considered bad leads. Leads from current PPL members are not considered bad leads. 10. E-Mail Delivery of Leads Webwerxx, Inc. will attempt to deliver all leads to the member's email address but it is possible that some internet service providers will not allow large volumes of e-mails coming from one source. If we cannot deliver the leads to the specified email address, we will attempt to contact the client for an alternative email address. Ultimately, it is the responsibility of the Subscriber to provide a working email address and to ensure that spam filters are disabled.     By clicking below, I agree to the above terms and conditions.
